Business Overview
Up All Night Baking is a licensed home bakery operating in Lemont, Illinois, under the Illinois Cottage Food Law. All products are prepared in a home kitchen that is not inspected by the Illinois Department of Public Health.
Orders and Custom Requests
All custom cakes, cupcakes, cookies, and specialty desserts are made to order.
Submitting a custom order request does not guarantee availability. Orders are confirmed only after direct communication and final approval of design, flavor, pickup date, and payment terms.
Because each product is handcrafted and personalized, slight variations in design may occur. While we strive to closely match inspiration photos or design ideas, each cake is an original creation and may vary slightly in color, decoration placement, or detail.
Payment Terms
Payment terms will be communicated at the time of order confirmation.
Orders may require:
- A non-refundable deposit to secure your date
- Full payment prior to pickup
Orders are not considered confirmed until payment arrangements have been completed.
Failure to submit payment by the agreed deadline may result in cancellation of the order.
Cancellations and Changes
Due to the custom nature of our products, cancellations must be requested as early as possible. Deposits are non-refundable because they secure your date and cover preparation planning.
Changes to flavor, size, or design may not be accepted within a certain timeframe before pickup. Once production begins, changes cannot be made.
Pickup Policy
All orders are pickup only at the agreed location and time.
It is the customer’s responsibility to arrive at the scheduled pickup time. If you are running late, please communicate promptly.
Once the order has been picked up and leaves the premises, Up All Night Baking is not responsible for damage caused by:
- Improper transportation
- Excessive heat
- Direct sunlight exposure
- Refrigeration issues
- Mishandling
We recommend transporting cakes on a flat surface in a temperature-controlled vehicle.
Storage and Care
Customers are responsible for properly storing cakes and baked goods after pickup.
Buttercream cakes should be kept refrigerated if not served immediately and brought to room temperature before serving for the best flavor and texture.
Detailed care instructions may be provided at pickup.
Allergy Disclaimer
Up All Night Baking operates in a home kitchen that may process common allergens, including, but not limited to:
- Milk
- Eggs
- Wheat
- Soy
- Peanuts
- Tree nuts
While we take food safety seriously and hold a food handling and allergy certificate, cross-contact cannot be completely guaranteed in a home kitchen environment.
Customers with severe allergies should carefully consider this before placing an order.
Cottage Food Law Disclosure
In accordance with the Illinois Cottage Food Law, products are made in a home kitchen that is not inspected by the Illinois Department of Public Health.
All labeling and handling follow applicable county and state regulations.
Intellectual Property
All images, designs, branding, logos, and website content belong to Up All Night Baking. Photos of custom cakes may be used for promotional purposes unless the customer specifically requests otherwise.
Customers may not reproduce designs or use images for commercial purposes without permission.
Limitation of Liability
Up All Night Baking is not liable for:
- Damage to products after pickup
- Allergic reactions
- Delays caused by customer pickup issues
- Indirect or incidental damages
Our liability is limited to the value of the purchased product.
Website Use
By using this website, you agree not to misuse content, attempt unauthorized access, or submit false information.
We reserve the right to update website content, pricing, or policies at any time.
Changes to Terms
Up All Night Baking reserves the right to modify these Terms and Conditions at any time. Updates will be reflected with a revised effective date.
